The short story is the Blade lost this case before the NLRB big time. Here\'s the end game:

REMEDY

Having found that the Respondent has engaged in an unfair labor practice, we shall order it to cease and desist and to take certain affirmative action designed to effectuate the policies of the Act. Specifically, having found that the Respondent has violated Section 8(a)(5) and (1) of the Act by unilaterally, without notifying and bargaining with the Union, changing a work rule and disciplinary policy for its pressroom employees, the Respondent shall be ordered, upon the request of the Union, to rescind the unilateral changes found herein. The Respondent shall also be ordered to notify, and upon request, bargain with the Union, as the exclusive collective bargaining representative of its pressroom employees, before implementing any changes in wages, hours, or other terms and conditions of employment of unit employees.

ORDER: The National Labor Relations Board orders that the Respondent, The Toledo Blade Company, Inc., Toledo, Ohio, its officers, agents, successors, and assigns, shall

1. Cease and desist from (a) Refusing to bargain with Toledo Newspaper and Printing Graphics Union No. 27N, affiliated with Graphic Communications International Union, AFL– CIO, as the duly designated representative of its employees in the appropriate bargaining unit, by making unilateral changes to its work rules and disciplinary policy. (b) In any like or related manner interfering with, restraining, or coercing employees in the exercise of the rights guaranteed them by Section 7 of the Act.

2. Take the following affirmative action necessary to-effectuate the policies of the Act. (a) On request of the Union, rescind the unilateral changes found herein. (b) Before implementing any changes in wages, hours, or other terms and conditions of unit employees, notify and, on request, bargain with the Union as the exclusive collective-bargaining representative of employees in the following bargaining unit: All pressroom employees, who work in pressrooms operated by the Respondent, and on all printing presses-employed in the pressroom, including but not limited to gravure, offset and letterpress printing presses and associated devices, but excluding all office clerical employees, guards, and supervisors as defined in the Act. (c) Within 14 days after service by the Region, post at its facility in Toledo, Ohio, copies of the attached notice marked "Appendix."15 Copies of the notice, on forms provided by the Regional Director for Region 8, after being signed by the Respondent’s authorized representative, shall be posted and maintained for 60 consecutive days in conspicuous places including all places where notices to employees are customarily posted. Reasonable steps shall be taken by the Respondent to ensure that the notices are not altered, defaced, or covered by any other material. In the event that, during the pendency of these proceedings, the Respondent has gone out of business or closed its facility involved in these proceedings, the Respondent shall duplicate and mail, at its own expense, a copy of the notice to all current employees and former employees employed by the Respondent at any time since July 23, 2002. (d) Within 21 days after service by the Region, file with the Regional Director a sworn certification of a responsible official on a form proscribed by the Region attesting to the steps that the Respondent has taken to comply.

I had the oportunity to listen to Brian Wilson, WSPD 1370 yesterday afternoon and listened to his detailed description of the fact that "union thuggery" was a major cause of Toledo's economic decline.

No way, Brian Wilson said that?? Well, it must be true! He is, after all, a well-respected economist!

I dont think it's so much 'thuggery' as it is 'mentality'.. This has been a manufacturing town for decades, and now that manufacturing is on the decline, we arent keeping up - the toledo politicians are hooked up so tight with the unions that they do nothing to proceed. They only want to keep trying to revive what's already here.

We cant always expect to have a lot of manufacturing jobs around - be it from companys moving to friendlier places, or thru technology.

How far in the past should we stay? Should we go back to where you pulled into a gas station and 3-4 guys come out? Elevator attendants?

We need to get with the times, and it's not thru 'thuggery' that unions have such a tight hold on our city government... (might be 'buggery' tho...)

Paul is right. This was POSTED on 3/16/07. It looked to me like it was referencing one of the prior decisions but I am wrong.

This is just one of the earlier unfair labor practice decisions against the Blade. But it was news to me. And explains alot about the current situation.

You hit the nail on the head Billy. All Toledoans...businesses, individuals, government....needs to be more proactive and be prepared for economic and technological changes rather than always playing catch up.

NLRB Charges Illegal Lockout at the Toledo Blade

CLEVELAND, Jan. 4 /PRNewswire-USNewswire/ -- A regional director for the National Labor Relations Board issued complaints of widespread labor law violations against the Toledo Blade including a charge that the newspaper had illegally locked out over 200 production workers last August.

The director for NLRB Region 8, Frederick J. Calatrello, set a hearing date of March 19, 2007, to try charges that the publisher has failed to bargain in good faith with its unions and violated the National Labor Relations Act by locking out printers, mailers, paper handlers and engravers, whom it has temporarily replaced. The employees are represented by local unions of the Communications Workers of America and the Teamsters.

If the Blade is convicted of the charges, the workers could receive an award for back pay and benefits.

"The NLRB complaint has vindicated our locals' bargaining position and focused the blame for this unnecessary labor dispute on the company. Hopefully, they will now bargain in good faith so that our members can get back to work with a fair contract," said Bill Boarman, head of the CWA Printing Sector and a CWA vice president.

Journalists represented by The Toledo Newspaper Guild, another CWA affiliate, also have been bargaining with the newspaper but so far have not been locked out.

The labor board also issued multiple complaints charging that newspaper management committed various illegal acts including coercive surveillance of workers and threats to fire workers engaged in activities protected by the NLRA.

Issues in the dispute include demands by the Blade for major cutbacks in wages, health care and other benefits as well as for weakening job protections and grievance provisions, according to the unions.

Of note, a lot of established union bullshit is allegedly absent. Correspondingly, some union protections are also absent. Features of this plant:
