As you should all know by now Franklin County Common Pleas
Court Judge David E. Cain is supposed to make a decision on the 14th
about Private Clubs being exempt or not. He already ordered a
temporary order which took away the Private Clubs Exemption.

My question is why a warning letter can not be appealed? If the
allegations leading up to the warning letter are false then the first
violation is a fine. The first violation is supposed to be the
warning letter.
Here is the process by which Ohio's indoor smoking ban on
employers, businesses and public places is enforced:
Complaint made to Ohio Department of Health.
Complaint referred to local health department.
Notice sent to alleged offender.
Alleged offender has 30 days to offer evidence to dispute claim.
Local board investigates and determines if violation occurred.
Alleged offender has 30 days to provide additional evidence.
If first offense, violator is sent a warning letter. If not,
violator is fined.
In the case of a fine (not a warning letter), the accused has 30
days to seek administrative review by impartial decision-maker
appointed by board.
Impartial decision-maker makes recommendation.
Local board makes final decision.
Accused has 15 days to appeal to Franklin County Common Pleas Court
in Columbus.
Appeal of that decision may be made to 10th District Court of
Appeals in Columbus.
Appeal of that decision may be sought before Ohio Supreme Court.
Wow here when I read the ballot initiative I thought that private clubs would be exempt.
That's what that reading will do... confuse you. I guess I'll just stay home and drink Kool-aid to please Judge Cain.

I found an article that shows all the board of directors for this Maryhaven, etc. and how Judge Cain factors in. I'm too tired tonight - will dig it up & post it here tomarrow. He stands to make a lot of money with this smoking ban - with the rehab & smoking cessation programs at Maryhaven. Doesn't it seem odd that ALL reported smoking violations that are appealed have to go through Franklin County through JUDGE CAIN????????? HUGE conflict of interest.
He says the following-pay close attention, now, class-
