If one refuses to pay property taxes, what will happen? Can one's property be confiscated?
If so, technically property taxes could be modern day form of slavery. At the most plain and stripped down level, you really don't own your property unless you pay your taxes. You own property to profit the state
Does anybody have any literature to counter the legality other than blowing smoke up our ass rhetoric?
Conservative bitch about taxes and I understand that the government spends money on a bunch of shit it probably shouldn't, but how do conservatives think we should pay for things like police, fire and road repairs?
So a retired person living in a home would pay zero taxes?
In my opinion any retired person should not have to pay tax, but that is not the case. Many retirees have lost their homes due to the high property taxes.
I'm no fan of taxes, but I think they're constitutional. Taxes are a legislative issue (one of priorities and policy) not a judicial issue.
Property taxes are ONLY assessed to property owners.
That means if I own a house and YOU don't, I am forced to pay for YOUR police, fire and schooling.
The answer?
Get rid of the IRS and either have a flat tax, I.E. EVERYONE pays the same percentage of their income in tax, no deductions, no loop holes, no crying
-or-
get rid of all property taxes, etc and just have a sales tax for everything.
Bullshit...property taxes are passed on to renters. God knows the local right wingnut radio station reminds everyone of that every time there is a tax levy on the ballet.
Also a national sales tax is a horrible idea. It would completely make someone saving worth considerable less. It would screw retirees the hardest.
...you wouldn't try to raise the rent to pay for the increased taxation? Everybody pays for taxes (either directly or indirectly). Though I do like the idea of "consumption" (sales) tax.
Take the IRS out back and shoot them one at a time. That will make a good beginning to a better world for everyone.
On a more serious note, abolish income and property tax. Start using a sales tax to fund everything. The reasoning here is that the government would be able to tax certain classes of goods (such as food and medicine) at a much lower rate than, say, luxury items.
Property taxes are not passed along to renters, contrary to popular belief. Certain tax breaks are given to landlords which offset any property tax they might be charged, although most landlords will not admit it, they pay very little tax on their holdings.
Except you’ve just wiped out my savings! I’ve got $20,000 saved up for a new car. Now you expect me to pay 25-30% national sales tax on my new car? Now I can only afford a $15,000 car. That’s bull shit! I’ve already paid taxes on that money.
How about my Roth IRA? I’ve already been taxed on the thousands I have saved for retirement. Now I have to pay an additional 25-30% on top of the taxes I’ve already paid?
Also I’ve saved a considerable amount of money in my 401k. I won’t be taxed anywhere near 25-30% when I begin to withdraw.
This would also affect my retired parents considerable. They have saved a reasonable nest egg to retire and pay little in income tax. Now they have to pay 20-30% on everything? Hell, one of them might have to go back to work.
Unlike income taxes which penalize me for improving my earnings and thereby my overall position, consumption taxes allow me to control my taxes without forcing me to lower my income to avoid taxes.
Bring on the consumption tax! (without of course taxing the first $XXX on food and other basic necessities...)
Only wiped out savings if you spend it?
The only reason I've got saving is to some day spend it. Not have it eaten away by 25-30% tax. My $20,000 in my car fund would only be worth $15,000 in your tax world. $5,000 buys a lot of car.
Also, I have never experienced or heard of anyone saying they didn’t want a raise or take a promotion for money, because they didn’t want to pay more taxes.
Under today's system, the $20,000 car price includes approx 22-26% embedded taxes. Consumption taxes that replace existing tax structures, such as the FairTax, would do away with those embedded taxes. You no longer have a $20k car price; your life just got more affordable.
You're assuming that the saving get's passed to the consumer. Also a national sales tax would be around 25-30%...still a loss for me.
You're assuming that the savings do not get passed on to the consumer.
I apparently have more faith in the spirit of competition and free markets than you.
As to the rate, it's a 23% tax-inclusive rate or a 30% tax-exclusive rate. While the stated rates are different, it amounts to the same tax being paid.
What happens to all the supply in the supply chain? That used F150 sitting on the lot for $20,000 won't suddenly be reduced by 20-30%? But I won't be able to afford it with a 20-30% tax!
How about the new cars sitting in a parking lot? Will a 2009 truck cost 20-30% less then the 2008 sitting here?
Also how about the $1000 HD LCD in the local Wal-mart? Built in China, shipped to a port on the west costs and sitting in the store all in a matter of weeks?
Once again, I have to spend 20-30% extra on the TV from my savings.
Who could afford to buy anything with both a federal and state sales tax. OH! and don't forget the local sales tax that will pop up if you're eliminating income and property taxes.
Carty's got to pay for someone to scoop up his dogs poop and his new flower pots some how.
The money I've saved is money I've already paid taxes on, slap on a federal sales tax and now you're double taxing me.
Who gets to decide your monthly food allowance before they tax that since you've stated the first bit of money spent will be tax less.
Start taxing our food and now people can't afford to feed their families. Brilliant move.
Do it on my Chicago rentals, do it here.
Any landlord not accounting for taxes is a fool, or racking up "losses" while running a tax shelter. Sure I enjoy the tax breaks afforded by the tax code and treasury regulations, but I charge renters too!
Landlords don't "pass on" taxes to renters directly because rents are set at the market rate. At least business savvy landlords don't. Business savvy landlords would do the research and analysis to find what rent brings in the most revenue. "Passing on" additional property taxes to renters could backfire and lead to significantly less revenue if the market determines that the increase in rent is unaccepted. Of course, on the other side if a landlord raises rents following a property tax hike and the market still supports that level of rent, then they previously (before the tax hike) priced their apartments too low and weren't reaching their revenue potential.
An increase in property taxes ultimately causes increases in rents, but it's more a function of an increase in the number of renters (do to increasing property taxes) driving the supply down and the demand up.
The problem is that taxes are not simple. Our Govt. wants it all that way. Keep everything so complex. The taxes and the spending.
Make it ALL simple. You don't need any tax at 20 to 30 % thats BULL SHIT !
Tax ONLY a persons INCOME and Nothing else. Not savings, just income from employment.
No federal sales tax!
Tax a busness on the GROSS !
Let each business and person have the first 20,000.00 tax free.
After that ALL gross income is taxed at a flat rate!
A rate of 7% for business and 5% for persons.
No more IRS.
Business would save a ton of money from not having to have several accountants.
The Govt. would save Billions from not having the IRS.
Persons would not even need to file tax returns. As their employer would simply send their 5% to the Govt. each month.
Hard to cheat!
Simple.
And the Govt. would have more money in the long run.
Now if we can get the Govt. to stop waste !
Now as for Local issues. Police, fire etc.... Do the same with the state. Flat state tax. NO other state or local taxes. No Property taxes.
The state alreaady gets ALL the money from property taxes. Then the state sends the money to the counties and to the schools. BUT not all. Some stays with the state. Gee I wounder why?
Make it simple. Keep it simple.
And this is a fair way. everyone pays and pays the same rate!
AND young children and senors will not pay much or at all. We should not be taxing them anyways! First 20K non taxed! A person needs to eat! If thats all a person has as income, let them have it! And we don't need our young childrens taxes from small jobs they have until after collage!
What will be taxed next? The Air we breath. Sex! Enough!
Flat and Fair ! Simple!
Except we don't even agree what is income. I think a guy making via the stock market should be taxed the same as if he had received a pay check.
Who voted yes? I would like to know, tell me how it is Constutional to tax a man's HOME?
It gets taxed Every 6 months. Forever!
What would you do if you got a sales tax bill on your new car every 6 months?
And the county set its value.
And Govt. cannot pass laws that are not Constutional. They have, do.
Their only getting away with it because we let them!
What exactly is unconstitutional about real estate taxes? Point to the section of the Constitution that you believe prohibits taxation on real estate. I don't think you'll find it.
People, in general, believe everything is an issue of Constitutionality. Most things are not issues of constitutionality, they are matters of legistlation. You may not agree with something, but that doesn't mean it isn't constitutional. If you don't agree with something then change it at the legislative level.
