1. LCCS (no longer CSB) does not need an ex parte order to remove children from a home when caseworkers believe they are in danger of abuse or neglect. In such cases, they go to court later (usually within a week) to get agency custody.

2. While I sympathize with your desire to regain custody, your decision to drive to Delaware OH and retrieve your ex-girlfriend's child was not well thought out. You took the law into your own hands instead of fighting the system the legal way. As a result, it sounds like you were correctly charged with kidnaping, since neither you nor your ex-girlfriend had legal custody.

3. CASAs are legal advocates for the child, not child care experts. Their role is to represent the child's interests in court and legal proceedings. Some are excellent, some are average, and a few are worthless (IMHO). There were some CASAs we dealt with who spent a lot of time with the children in foster care, while others only showed up on court dates. A few we never saw at all.

4. As far as attorneys, not many will want to take on a case like this based upon the kidnapping charge. Unfortunately, the decision to retrieve your ex-girlfriend's daughter simply made her look even more like an irresponsible parent. As far as the judge's "bias" - I would hazard a guess and say that the judge takes a dim view of lawbreakers. Most of the family court judges I have dealt with bend over backwards to give birth parents the chance to clean up their acts; I even know of a case where an adoption was held up a year because the birth parent - an incarcerated pedophile, no less - played jailhouse lawyer and filed motion after motion to try and win back custody of children he wouldn't even be able to care for, since he would be in jail until they were almost adults.

5. If a CASA did indeed break into your home, did you report the crime? Just because they have legal status in court does not give them the right to commit crimes.

Toledo’s child welfare policies are a disaster for children and families. That is why, in Toledo, every year, teenagers exit the system without any resources from the system that took them from their parents under the guise of protecting them.

They have no support from the very agency who removed them from all family and turned them over to strangers (foster parents). In most cases this was accomplished with the consent of the CASA person who is supposed to work for the best interest of the child. In most cases the best interest of the child was never considered even when the child was able to verbally communicate with the CASA. The best interest of any child regardless of circumstances is to maintain contact with the biological family. When this happens there is a relationship based on ties that bind and not ties that are broken at the whim of the foster parent.

I recently met a young male teenager who at the age of 14 has had 29 foster care placements. In other words he has had to adjust to 29 different families and their habits. These many placements are not unusual. He does not know his biological family, yet he yearns for them. (Watch Antoine Fisher). In four years he will leave foster care and proceed to attempt to become an adult without any human relationships or realistic life skills to sustain him.

Children are removed from foster families at the whim of the foster parent or the caseworker. You may say that the child had issues that the foster parent could not handle or the child was a threat to the foster parent’s family, or the child ...............whatever. My own children that I adopted had been in at least 8 foster homes before they were placed with me for adoption. The youngest was two years old. From six weeks old (when taken from the mother) until the age of two (when placed with me) what could a baby possibly do to have to move 8 times. That is once every three months! All of this was with the consent of the CASA who had the best interest of the child at heart! Absolutely insane!

CASA’s and foster parents do not develop and sustain relationships with the child’s biological families and thereby destroy any future relationship the child may have with the parent. I have seen too many times where CASA’s go along with LCCSB’s decisions based on what the caseworker said and sometimes those caseworkers lie.

The CASA agency in Toledo is replete with ethics violations. In the child welfare “gang” you can become a LCCSB caseworker, then become a CASA, then become a magistrate, all with the power of removing children and destroying families. A CASA is a human being just like you and I. We all have faults, make mistakes and sometimes fall short. These people are not know al, see all gods. CASA’s, Judges, Caseworkers all live with the same societal issues that the parents of the children who they destroy with their policies, procedures and whims live with.

My heart goes out to all children placed in this situation.

may be something as simple as a magistrate walking through the juvenile justice center on Spielbusch and talking to a CSB worker who is also walking through the building. They decide, on their walk, to execute an order without going through formalities or proper procedures.

a very large number of families would not pass the sniff test according to LCCSB. No family should receive the "death penalty," regardless of the ammunition, unless good faith services are provided and "good faith" efforts are made to preserve the child's biological family.

Abolish the Death Penalty for families!
