Joe Legal pays medical and dental insurance with limited coverage for his family at $600.00 per month, or $7,200.00 per year. Joe Legal now has $24,031.00.
Jose Illegal has full medical and dental coverage through the state and local clinics at a cost of $0.00 per year. Jose Illegal still has $31,200.00.
Joe Legal makes too much money and is not eligible for food stamps or welfare. Joe Legal pays $500.00 per month for food, or $6,000.00 per year. Joe Legal now has $18,031.00.
Jose Illegal has no documented income and is eligible for food stamps and welfare. Jose Illegal still has $31,200.00.

Joe Legal's and Jose Illegal's children both attend the same school. Joe Legal pays for his children's lunches while Jose Illegal's children get a government sponsored lunch. Jose Illegal's children have an after school ESL program. Joe Legal's children go home.
Joe Legal and Jose Illegal both enjoy the same police and fire services, but Joe paid for them and Jose did not pay.

The obvious solution is the fine the crap out of the owner of the contruction company and throw his is ass in jail. Start making examples out of the ones doing the hiring and people will stop comming here.

Of course that would be hurting business. So they will deport Jose Illegal and the owner of the contruction company will hire Juan Illegal tomorrow. No skin off his back.

If anyone has a job, they have filled out an I9 form submitting two forms of identification. It is also called the " Employment Eligibility Verification Form". You can give copies if your drivers license, state ID, Social Security card, etc.
The I9 that is filled out when you are hired was part of the Reagan amnisty bill of 1986.

Here is what the I9 is supposed to do:

"In 1986, Congress was debating many of the same questions as in recent years regarding illegal immigration and the best way to gain control of the border. The debated ended with passage by Congress of IRCA and ratification by President Ronald Reagan.

Central to IRCA was a section that created an employer sanctions system that requires all employers in the U.S. to verify the identity and employment authorization of nearly all employees hired since the law was passed in 1986. Employers would basically become a central part of the immigration enforcement process by having to take over responsibility for verifying that the employer’s employees are legally in the country. Shortly after the law passed, the INS created Form I-9 to document that the employer has met its IRCA obligations. Employers are not permitted to knowingly hire unauthorized immigrants and properly completing the Form I-9 is the method for employers to demonstrate they lack knowledge that an employee is not eligible to be employed. "

In other words, once an employer receives an I9 properly filled out, EVEN IF IT INCLUDES FORGED SUPPORTING DOCUMENTS, the employer is off the hook. Since the employer IS NOT AUTHORIZED TO RESEARCH I9 SUPPORTING DOCUMENTATION, this law regarding the I9 is worthless.

and yet we still have illegals and no one is talking about making it as hard on them as they do the illegals.

Bottom line, an employer cannot do a background check by law unless specifically excempted (I.E. excemption when working with children etc), an employer cannot verify documentation, etc. Privacy laws prohibit researching documents.

The only way to make absolutely sure that an illegal cannot get a job in America is to STOP THEM AT THE BORDER or send them back over the border when caught in America. That way, if someone is in America with an American drivers license, they are almost 100% guaranteed to be legal Americans.

The I9 you filled out PROVES THE EMPLOYERS "LACK THE KNOWLEDGE THAT AN EMPLOYEE IS NOT ELIGIBLE TO BE EMPLOYED"

*EDIT* The above comment from the IRCA doesn't make much sense since it is a double negative. Let me put it into laymans terms.
The I9 form supplied by INS (United StatesImmigration and Naturalization Service) and filled out by an employee says that the employer cannot prove that you are NOT an illegal immigrant. It does NOT prove you ARE legally able to work in America, it only gives employers a way to defend themselves in court. "Hey, he showed me a California drivers license. I cannot verify if it was a real drivers license so I was forced by privacy laws to accept the forged document as a real license. It's not my fault."

So all 389 illegal and many under age workers had forged docs? Some 13 year old kid shows up with a drivers licence that says "McLuvin" and they hire him.

These companies have nothing to loose by knowingly hiring these workers.

Also if someone is working with forged documents then they are paying taxes including SS tax to the federal government.

SO THE ANSWER TO YOUR QUESTION "So all 389 illegal and many under age workers had forged docs?" IS APPARENTLY "YES" AT LEAST 297 OF THOSE 389 HAD FORGED DOCUMENTS. More criminal charges if the Illegals who worked in that plant are pending.

Or, can you answer my question. How is a business supposed to verify if a person is legally able to work in the U.S.? And why is it up to a private business to verify someone's citizenship when it is in Article IV, Section 4 of the U.S. Constitution that Congress will protect the U.S. borders?

I read it, and I read between the lines. They got "duped" almost 400 times? Come one. They knew who they were hiring and why not. They got to work them 12-17 hours per day and pay them $7.50 per hour. They got busted and I'm sure hired a new batch the next day and why not there would never be any ramifications.

If the paper work is good enough to get a job, wouldn't it be good enough to cross a border?

As for closing the border, currently Obama has deported more illegals in the last year than Bush did in any of his years.

We have previously established that:

1) most if not all of the illegals in your article had the forged documents they needed to get a job in America and get around American law
2) Due to privacy laws, it is illegal for an employer to VERIFY those documents (In other words, it is ILLEGAL for a business to ask and therefor can be easily "duped")
3) It is the responsibility of Congress to protect the borders

So, why is it OK for you that we ignore closing the borders and put the burdon of proving citizenship of a worker on private business?

If Congress were doing their job and protecting the border, there would be no reason for a private business to take that responsibility.

Why not change the law to make companies more responsible. As long as there are jobs here, illegals will come. If the documents are good enough to fool an employer, they'll most likely get you through a border crossing.

We've had our borders closed to drugs for 50 years...how is that going for us? Afghan heroin is hitting a new street low.

Exactly how long is the border between Mexico and Iowa (where this meatpacking plant is)?
Does Iowa REALLY have that much of a problem that they HAVE to break US Privacy Laws and verify each document? Hell, Congress won't even allow you to prove you have the right to vote.
How many states are there between Mexico and Iowa?
How many times could illegals have been stopped between Iowa and Mexico?

Get serious about the border. Stop the problem at the source and everything else will fall into place INCLUDING lowering HealthCare costs for everyone.
