Obama backs EEOC Suing BMW And Dollar General For Racial Discrimination.

WASHINGTON — The Equal Employment Opportunity Commission filed lawsuits Tuesday against discount retailer Dollar General Corp. and a BMW manufacturing plant in South Carolina over their use of criminal background checks to screen out job applicants or fire employees.

In both cases, the agency claims the practice discriminates against African-Americans, who have higher arrest and conviction rates than whites.

In the Dollar General case, the EEOC filed a nationwide lawsuit in federal district court in Chicago based on charges of discrimination filed by two rejected black job applicants. One applicant was offered employment even though she disclosed a 6-year-old conviction for possession of a controlled substance, the EEOC said. But her job offer was allegedly revoked because Dollar General’s policy was to disqualify anyone who had that type of conviction within the past 10 years.

The EEOC alleges that BMW’s policy affected dozens of employees working for a contractor that staffed a BMW warehouse in Spartanburg, S.C. The contractor’s policy was not to employ anyone with a criminal record within the past seven years.

If there's any justice whatsoever left in the federal circuit, this suit will get squashed.

If people who have criminal records can't get jobs they have no choice but to continue being criminals. Once these people have paid their debt to society, why do they have to keep paying?

There's no such thing as having no choice but to continue to prey on your fellow man.

And if you keep making that choice, eventually we'll just slaughter you.

Whatever your ethnicity happens to be, you deserve a huge payout if you're fired because of false data in a background check and they didn't immediately bring you back. And if a VP didn't greet you at the door with apologies and a check for any lost wages during the time missed, fuck 'em and call 1-800-CALL-SAM. Not making it square with an employee who was the victim of a clerical error is unconscionably unprofessional.

How is that the employers fault?

The employer has a stated policy. If the background check is wrong it sounds like its the fault of the reporting agency not the employer.

The employer should be able to rely on the state's records to be correct, should they not? What recourse should the employer have against the state for providing false information?

I know a man who worked on a project financed by the government 20 years ago. He spent almost a decade in prison because the operation went wrong. He can't get a job anywhere. He's paid his debt to society so let him work.

Then start a business and give these people jobs.

I am an employer and there are people who work for me that have crimminal backgrounds.
