You'd have to register 100 fake people, create ids for the 100 fake people and then have 100 people show up to cast votes using the fake ids.

When you pay people register voters you risk someone registering a bunch of fake names to get a bonus.

No one has ever proved that any of these fake registrations have cast a vote.

Darnell Nash, man who voted in presidential election with fake address, is indicted

A man who cast a ballot using a fake address in last fall's presidential election was indicted Thursday on charges of tampering with records, false registration and illegal voting.

The indictment of Darnell Nash -- who address was unknown -- was the first by the Cuyahoga County prosecutor's office from a seven-month investigation of voter registration practices. Assistant prosecutor Rick Bell said detectives with the Cuyahoga County Sheriff's Office continue to investigate.

The inquiry started when workers at the Board of Elections flagged dozens of registration cards turned in by ACORN, the Association of Community Organizations for Reform Now, which tries to get low- and moderate-income people to register.

Meanwhile the Associated Press reported that four former Pittsburgh-area ACORN workers this week were ordered to stand trial on charges they forged or otherwise illegally solicited voter registration cards before the election, a St. Louis ACORN worker awaits sentencing after pleading guilty to mail fraud for submitting false voter registrations, and the Nevada attorney general has charged ACORN and two of its supervisors with requiring illegal quotas of 20 cards per shift and firing workers who didn't meet them.

Nash -- who registered to vote in Cuyahoga County nine times last year using false names -- was a no-show at a board hearing in October where he was subpoenaed to testify with other repeat registrants.

At the hearing, board workers said they had contacted Nash during the summer and told him to stop registering, yet on Sept. 30 he signed up again and voted early using a false address on Lee Road in Shaker Heights.

His paper ballot was flagged and not counted since board workers recognized his name, according to election officials and the prosecutor's office.

Nash was charged with 19 counts on the three charges. All are felonies.

Ohio Secretary of State Linked to ACORN, Project Vote

The national development director for Project Vote, an affiliated organization of the Association of Community Organizations for Reform Now, or ACORN, has been linked to embattled Ohio Secretary of State, Democrat Jennifer Brunner. Karyn Gillette of Project Vote was a campaign consultant for the Brunner campaign, according to information found in a post made by Rick Brunner on April 11, 2006 on the secretary of state’s own blog.

“Our candidate had gone earlier in the day to have some meetings and work out of Karyn Gillette's office, but when your correspondent arrived in his S-10 pickup truck, our staff person, Lauren, drove that back to Columbus, while we continued on to dinner with Craig Bashiene and John Lancione. We were accompanied by our consultant, Karyn Gillette. Karyn and her business partner, Mary Grace, have been very helpful to the campaign.”

The links between Gillette and Brunner do not end there.

According to a court filing in Ohio alleging ACORN violated state Racketeer Influenced Corrupt Organizations (RICO) law, “Project Vote, regularly advises Ohio Secretary of State Jennifer Brunner (hereinafter “Secretary Brunner”) on election strategy, and recently issuing a news release claiming credit for Secretary Brunner’s directive restricting challenges to suspected unlawful voter registrations.”

Maurice Thompson, the attorney handling the Ohio RICO action, told me late yesterday, “Evidence of collusion amongst ACORN, Project Vote, the Obama Campaign and Ohio Secretary of State Jennifer Brunner comes as no surprise to us -- these supposedly separate entities appear to have been comingling funds, trading political tips, and helping each other gain power for years now. Those who think this is merely a complex transactional matter should think again -- these shell games are being played with taxpayer dollars and have a corrupting influence on our elections.”

Gillette’s problems do not end there.

In testimony Wednesday in the lawsuit brought by the Pennsylvania GOP against Project Vote, former D.C. ACORN staffer Anita Moncrief stated under oath that in November 2007, in ACORN’s D.C. offices, Gillette gave Moncrief an Excel file of donors Gillette said she had gotten from the Obama campaign, told Moncrief to de-dupe the file and identify the campaign’s maxed-out donors to call for “get out the vote” contributions. Attorney Heather Heidelbaugh told me in an interview yesterday, “… before we started the hearing, ACORN’s attorney, Catherine Simpson -- again before we started the hearing -- said one of her witnesses was going to be Karyn Gillette, Anita’s supervisor. After Anita said on the stand that Obama’s campaign contacted Karyn Gillette -- Karyn Gillette was gone. She wasn’t in the courtroom. She wasn’t put up on the stand. Why? Because I would have asked her and she would have been under oath and she would have had to answer.”

Heidelbaugh also asked the court to order ACORN not to destroy evidence. “Anita testified on the stand that they were destroying evidence pursuant to other legal matters that they had,” she said.

Unraveling this massive organization’s activities will take a Herculean effort.

According to written testimony of James Terry of the Consumer Rights League, a group that acts as an ACORN watchdog, to the House Judiciary Subcommittee on the Constitution last month, “ACORN’s massive enterprise includes as many as 150 subsidiary organizations, according to a recent legal filing by members of its board of directors. The list includes two affiliated labor union locals, TV and radio broadcast operations, immense housing counseling operations, and a number of lobbying and political entities. In all, ACORN’s total operation this year has an estimated budget of $110 million. That’s big business.”

The Congressional testimony goes on to address juggling of funds and blame between entities to cause confusion and affirms, “… the non-profit organization known as Project Vote and the political operative organization known as Citizens Services Inc. are wholly owned subsidiaries of the ACORN web of organizations. There should be no distinction between crimes or alleged crimes perpetrated by personnel from Project Vote and those from ACORN.”

ACORN Docs Pulled from Dumpster

As Derrick Roach tells it, it was either luck or Divine intervention. His version of events may be hard to believe for ACORN supporters but the former Republican state assembly candidate believes something drew him to the dumpster behind the ACORN office in National City on the night of Friday, Oct. 9.

Roach recalled the moment he discovered thousands of ACORN documents simply bagged up and thrown in the trash.

He was driving home, he explained Monday, when a thought occurred to him to put his skills to use.

Roach, who describes himself as a local private investigator concerned about what was happening in his neighborhood, told how he “came by” the ACORN office and “observed some individuals in the office and also observed the individual dumping documents into the dumpster around the corner,” he said.

“I came back later that evening, after business hours, and from an unsecured dumpster removed those documents and they have been in my possession since,” he said.

The documents, which filled Roach's vehicle, numbered close to 20,000 according to Tony Krvaric, chairman of the Republican Party of San Diego County.

“This is a massive data breach at the very least of individuals who come to ACORN for help and assistance,” said Krvaric. “To have their information, tax returns, immigration documents thrown in the trash like common trash is absolutely an affront to every San Diegan.”

“[ACORN] cannot be trusted to be helping people here,” Krvaric said.

When reached for comment, Amy Schur of ACORN's state office, explained why the paperwork was in the trash.

"In early October, when our San Diego staff were doing an office clean-up in preparation for a major 10-station phone bank program being set up in our offices, it appears that included in the piles of garbage being thrown out may have been some documents containing private information," Schur wrote in an e-mail to NBCSanDiego. "To the individuals whose paperwork was pulled out of the dumpster by this guy Derrick Roach - unsuccessful Republican candidate for State Rep in San Diego - we truly apologize. We will seek return of this information so that we may give proper notice of the compromising of the information as required by law."

When asked about ACORN's policy for disposing of sensitive documents, Schur said, "It is ACORN’s policy to shred documents with personal information at the point when they no longer need to be retained."

Roach, who told reporters Monday that he has not been hired by the Republican Party of San Diego, said he has shared some of the documents with various law enforcement agencies.

“I have been specifically asked by certain government officials to not release some of the documents,” he said. He could not identify those officials at this time.

For Krvaric, the main question is what is the California State Attorney's General doing about this discovery?

“We have nothing to indicate the attorney general is conducting a thorough, fair, without fear or favor investigation,” said Krvaric. “They’ve not stated anything. Clearly there are documents that they’re missing because of this document dump that occurred only six days prior to the attorney general coming into town.”

They have not heard from Attorney General Jerry Brown's office, according to Krvaric. He would like Brown's office to contact him.

“The question is was ACORN tipped off as to when and where or when the attorney general would be arriving?” Krvaric asked.

Schur confirms the ACORN office was aware of Brown's upcoming visit but said that did not prompt the removal of thousands of documents.

"Absolutely not. Our files were not part of the scope of the visit by the Attorney General’s office, and the majority of what was thrown out was junk – old leaflets, newsletters, etc&hellip It looks like our staff were careless and some documents with personal information were included in the piles of garbage," Schur wrote.

In a written statement, Evan Westrup wrote "The Attorney General's Office has contacted the office of the individual who allegedly recovered these documents and has requested that he turn over all information which he believes relates to a violation of law or otherwise relates to our investigation."

"There is absolutely no truth to the assertion that the Attorney General's Office has come to any conclusions or that the investigation is complete. This investigation, like all investigations conducted by the Attorney General's Office, will be fair, comprehensive and independent."

Roach smiled when he discussed how he happened to be in the right place at the right time for the discovery. He credited both luck and God at times during Monday's news conference.

“This was an investigator’s dream to get information like this,” said Roach who did run for the California State Assembly 79th District Seat in 2008.

In September, California's attorney general and San Diego County's district attorney launched probes into allegations of voter registration fraud by staffers of ACORN.

One month earlier, there was nationwide news coverage of hidden-camera video stings that caught ACORN workers in five regional offices, including one in San Diego County, allegedly offering inappropriate advice and assistance to undercover filmmakers posing as a pimp and prostitute.

A local ACORN staffer in the the group's National City office was recorded Aug. 18 allegedly suggesting that Tijuana was a preferred border-crossing venue for a dozen underage prostitutes from El Salvador, because "I have a lot of contacts" there.

The ACORN staffer also inquired as to how much the purported prostitute charged customers. He was fired after the video was widely broadcast.

“I think we’re seeing the sad, last chapter of ACORN as we speak,” said Krvaric referring to the documents discovered outside the ACORN office.

"ACORN’s core mission is to help low and moderate income families organize and have a voice in order to improve the quality of life in their communities, and at this we excel – the proof is in the long record of accomplishments achieved by our members in making improvements on behalf of hard-working families," said Schur.

Voter fraud case traced to Defiance County registrations volunteer

Defiance County elections officials were confident the first three hadn't moved to their small community. But the fourth one lived there, and - in exchange for crack cocaine - tried to falsely submit the first three names and more than 100 others onto the county's voter registration rolls, police said.

 

Now Mr. Staton, 22, of Defiance, faces a felony charge of false registration in a case that has quickly gained national attention as part of a hotly contested presidential battle that's attracted a flurry of new voter registrations across the country - and a flurry of complaints of voter registration fraud.

 

Defiance County Sheriff David Westrick said that Mr. Staton was working on behalf of a Toledo woman, Georgianne Pitts, to register new voters. She, in turn, was working on behalf of the NAACP National Voter Fund, which was formed by the NAACP in 2000 to register new voters.

 

Sheriff Westrick said that Pitts, 41, of Toledo, admitted she gave Mr. Staton crack cocaine in lieu of cash for supplying her with completed voter registration forms. The sheriff declined to say how much crack cocaine Pitts supplied Mr. Staton, or to say whether Pitts knew that the forms Mr. Staton gave her were falsified.

 

"That remains under investigation," he said.

Defiance County sheriff's deputies and Toledo police searched Pitts' home on Woodland Avenue and found drug paraphernalia and voter registration forms, the sheriff said.

 

Pitts, who over the past two decades has been convicted of crimes ranging from domestic violence to resisting arrest, was not arrested this week. She could not be reached for comment. A month ago, she had just finished a year of probation for driving with a suspended license.

 

Pitts told police that she was recruited by Thaddeus J. Jackson II, who is coordinating the Toledo efforts of the NAACP Voter Fund.

 

Reached yesterday afternoon in Cleveland, Mr. Jackson described Pitts as a "volunteer" with the group but said he knew of no problems with her and of no voter fraud with her new-voter submissions.

 

"This is the first I've heard of it," he told The Blade.

 

He refused further comment on the case and representatives of the voter fund in Washington declined to elaborate on Pitts' involvement in the campaign.

 

In a statement issued late yesterday, Gregory Moore, the national executive director, said the group was "shocked" by the allegations, welcomed the investigation, and hoped it didn't hurt the reputation of other "volunteers and canvassers who have worked tirelessly to enfranchise the disenfranchised throughout the year."

 

Mr. Staton's 130 voter registration forms were among the 80,000 submitted to state officials by The National Voter Fund's Ohio office, based in Cleveland. The fund turned in Mr. Staton's completed forms to the Cuyahoga County Board of Elections, elections officials said.

 

Of the 130 forms submitted, county elections board director Wayne Olsson said that only six turned out to be legitimate.

 

Noting that the potentially new voters had listed addresses in Defiance County, Cuyahoga County elections officials sent the forms to Defiance County, where they arrived the afternoon of Oct. 8.

 

The package came with a small note inside from Cuyahoga County officials: Check the signatures on the cards for fraud.

 

Within an hour, Defiance County elections workers had deduced that the batch of 130 was mostly faked forms, said Laura Howell, the county elections board's deputy director.

 

"We could tell by the handwriting that many of them were written by the same person," she said. "And of course we know the streets. Defiance being a small town, many of [the forms] had streets not even in Defiance."

 

And so elections workers immediately began sending out letters, addressed to the people listed at those addresses, as a precaution to ensure that a Mary Poppins, a Jeffrey Dahmer, or a Janet Jackson didn't, in fact, live in Defiance County, she said.

 

Letters also went out to George Foreman, Brett Favre, Michael Jordan, and Dick Tracy, among others in the bundle to see if the post office would return them as undeliverable.

 

Letters even went out to a handful of people registered on forms with different personal identifiers but the same name: Chad Staton.

 

None of the Chad Statons made the cut.

 

In the meantime, elections officials contacted the office of Sheriff Westrick, a Republican, who began an investigation that included the Ohio Bureau of Criminal Identification & Investigation.

 

Sheriff's deputies arrested Mr. Staton as he walked along a Defiance street about 8 a.m. yesterday, and issued a press release by noon that soon spread across the Internet.

 

The Ohio Republican Party immediately seized on the scandal. In a statement issued hours later, spokesman Jason Mauk cited the case in claiming that "the effort to steal Ohio's election is under way, and it's being driven exclusively by interest groups working to register Democrat voters."

 

The Ohio Democratic Party responded that they don't condone any registration fraud. Spokesman Dan Trevas argued that, of the 500,000 forms submitted for newly registered voters, "the vast, vast majority are clearly eligible voters who did the right thing."

 

He called it a "stretch" to link the Democratic Party and the NAACP Voter Fund to fraud because "the volunteer to the volunteer did something fraudulent."

 

But it's not the first complaint of fraud against the NAACP Voter Fund, which insists it is nonpartisan.

 

Elections officials in Lake County, just east of Cleveland, last month began investigating the group and an anti-Bush group called Americans Coming Together, or ACT Ohio, for hundreds of suspicious registration forms and absentee ballot requests.

 

Among them was one, submitted by the NAACP Voter Fund, for a man who'd been dead for more than two decades.

 

Mr. Staton's arrest is not the first time someone who is paid to collect voter registrations or petition signatures has been accusing of falsifying them - such accusations have been made across the country.

 

And the NAACP Voter Fund is not the first group to come under fire.

 

Among the others are a Republican-linked group, Voters Outreach of America, which has been accused of destroying voter-registration forms its workers had collected from Democratic voters in Nevada and Oregon
