"We're too scared to have real trials in our country" is a level of cowardice unmatched in the world.

This is literally true: the Right's reaction to yesterday's announcement -- we're too afraid to allow trials and due process in our country -- is the textbook definition of "surrendering to terrorists." It's the same fear they've been spewing for years. As always, the Right's tough-guy leaders wallow in a combination of pitiful fear and cynical manipulation of the fear of their followers. Indeed, it's hard to find any group of people on the globe who exude this sort of weakness and fear more than the American Right. (continued)

It's not just the Right, it's ALL the politicians, as witnessed by the Obama administration's refusal to release the remaining photographs of torture, its reluctance to bring anybody to account for war crimes, and its continued path down the same war policies that the previous administration followed. It's just more of the same, just under a different political party. This just illustrates the hollow, rotting core that exists within both political parties.

I can't argue with any of those points Pete. But in the case of holding trials, as is required under the Constitution, the utter fear is rampant mostly among the right.

Eric Holder has no fortitude and took a pass.

He is passing this onto a judge in NY instead of having any strong will of his own.

He has automatically put whatever judge gets this case a legal ethics quandry. Any judge will be faced with the decision to throw the case out (since the terrorists weren't read their Miranda rights) or let the people who planned and conducted 911 go.

Apparently Holder's view is when faced with a tough decision pass it along to someone else.

You bring up some good points MikeyA. To me, this points out the folly of acting outside of the Constitution.

Well the problem is they're giving people constitutional rights who don't rate them.

By all actuality foreigners not here legally don't rate constitutional rights but the supreme court changed that.

Currently if you are in the U.S. and you recognize the soverignty of US law then you will recieve constitutional privileges.

The terrorists however do not recognize US authority. They committed an act of war. It's related to a supreme court case where Nazi saboteurs landed in Maryland and dressed in civilian clothes. They were taken into custody and were given military tribunals where they were decided there to be spies and were summarily executed.

Additionally Americans who attempt to overthrow the US gov't. Look up Schenck v. United States for a good read on treasonous acts versus the 1st Amendment.

The Constitution doesn't grant rights. It defines the government's boundaries.

"The RIGHT To Keep And Bear Arms Shall Not Be Infringed"? Well, pink slip-what part of "right" don't you understand?

Meaning the right already existed, and government cannot take that right away. It doesn't mean the government granted this right to us. Think about it, it government can grant rights, then they can take them away. (insert wingnut Obama joke here)

As a general rule G-man the constitution is a document that states the rights gov't cannot take away from the individual. However, it defers much to the states and their ability to grant/limit rights has been in debate since the founding of the nation.

In these cases the Supreme Court and US law has added definition. Meaning: individuals who do not recognize the authority of the US gov't and conspire against it (actually whether citizen or not) is not extended the rights preserved in the constitution. Even in Gen. Washington's time those guilty of treason were given military tribunals and not trial by jury.
