Toledo father sues over son gnawed by pitbull

From WTOL news: A Toledo father is suing Lucas County's Child Protective Services (CPS) claiming it's their fault a pit bull chewed off his son's foot.

Late November, 24-year old Martina Jennings fainted in court. A Lucas County judge had just sentenced her to four years in prison after her three-month old pit bull puppy chewed off her four-year old son's foot. Larry Dilabbio, Martina Jennings' attorney, told News 11, "If this weren't an inner city black family with a pit bull, I don't think the sensationalism would be involved."

How on EARTH would this be childrens' services fault??

What bullshit!! If it had happened to a white family on Ottawa Hills he thinks there wouldnt be sensationalism??

Is the issue the race of the person or the allegations;
"In his lawsuit, he said he called CPS nearly two weeks earlier saying his son with spina bifida was being physically abused in the home of Martina Jennings because of the presence of scrapes, wounds and bruises. The father took his son to the hospital where doctors suspected domestic violence.
They also completed a child abuse report, a physical assault body map and took photographs.
CPS removed the boy from Jennings' home, but gave him back days before the pit bull attacked. "
Seems that from the report, the department was aware of some alleged abuse and decided to put the child back into the home.

then a suit against CPS makes a little more sense, that wouldn't have been the first time they returned a child to a home where they were later killed or in this case horribly maimed.

I don't see the coverage of this having anything at all to do with the color of the family. A dog eating the foot off a child would be news no matter where it happened or what color the family was.

This default playing of the race card is disgusting, it does nothing except detract from legitiment complaints of racism.

Playing the race card is stupid. Pit Bulls alone are divisive. Any story involving an attack by them is going to get press. It does not matter what race the owner is.

I can understand his concern that he tried to report an abusive situation to CPS, and yet his son still ended up being seriously injured.

Whether or not they have any liability, I'm unsure. I suppose it depends on what (if any) actions CPS took. etc. (I wonder if it affects the CPS worker's judgement...even unintentionally...when its one parent filing a complaint against the other parent. I bet they get a lot of false/cry wolf situations when there's a custody dispute. Hopefully it doesn't keep them from taking legitimate complaints from the non-custodial parent seriously though.)

Ultimately, the mom is at fault for not protecting her child. But it is a damn shame that someone wasn't able to assist the father in getting the child out of that situation before the incident. :(
