...you may want to call the Toledo Bar Association to have them provide a list of lawyers who specialize in municipal claims or other similar category...they won't recommend a specific person, but can give you a list of those who've done this sort of work in the past. If money is an issue, Legal Aid of NWO may be able to help, as well.

Sorry to inform you, but this is a COMMUNITY blog. Part of what a community is, is lending a helping hand to your fellow community members. This country wasn't built on every man for themselves. Man, no wonder Toledo has been going down the shitter. Its' not because of the politicians, its' because of the lack of respect and unwillingness of its' citizens to work with each other.

I agree with toledo++ - what's with all the nasty sarcastic comments towards chad? He's just gone through a major hell with flooding & simply put out a request for information, & possibly a hand to help. Opal you're a new poster here - I assume you are THE Opal who wanted to turn downtown into an amusement park? I don't know your politics - but quite honestly, just based on your rudeness on this thread, I'd never vote for you for anything. Seems to me, I've seen a lot of posters ask opinions, for help, etc. on both here & toledotalk & I don't ever recall this type of mean spirited sniping regarding them. What's this board becoming? If you're only looking for perfect spelling & high brow thoughts, then I"ll just move it along. I've seen plenty of horrible typos from nearly every poster on swampbubbles & toledotalk - me included. I also see nothng wrong with a poster asking for suggestions on finding an attorney. Makes more sense to get a referral from somebody who's had some experience with one or two, rather than picking through the Yellow Pages. I'm really just stunned at the rudeness & sarcasm here.

Oh, I'm sorry. I had mistaken SwampBubbles as a user centered site dedicated to breaking news and political discussion of Toledo and Northwest Ohio. I had no idea it was a help wanted bulletin board. My basement took on water as well; I cleaned it up, got an insurance settlement and am now looking to install a sump pump. Can someone provide me with a reputable company who preforms this service. I have no need for a layer because I'm not sure why or who I should sue? It was an unfortunate event that certainly was not caused by anyone I know. The taxpayers of the City of Toledo certainly did not. I think that maybe the leaders within our community are coming to fast realization that they have not acted fast enough to update our storm sewage system. But, do I think that I am entitled to some sort of settlement from the City of Toledo so that maybe I could continue the renovation of my house. No, I don't believe so.

I got some good advice a couple of weeks ago. I realized I was in an argument that was just ridiculous and this same type of thing. My friend said basically what I had said out saying a long time ago. "You can tell the really nasty ones - just don't read their posts and you'll be fine".

So I'm getting my old list out :-)

There have been a LOT of threads here & on toledotalk that some people have been angered about, others have rallied behind them - lots of different opinions & lots of facinating conversations came from them (some I bashed my head against the wall about). tyler - please understand that every now & then, a new poster has come on full of spite & arrogance & nasty comments - out of the blue. That is how your post came off, at least to me. You acted like chad was doing some self promotion or begging for help. For what it's worth - I've disagreed with Chad & others here plenty (and they've got in my face plenty as well). But honestly -if I was in a situation that I felt I needed a lawyer (or doctor, plumber, roofer) - I'd wouldn't have a problem posting the question here. Worst case scenareo - nobody could help. Best case - somebody just may have had some luck with a particular lawyer (plumber). I really don't think that Chad presumed that he was the only person affected by flooding. Get your underbritches out of a twist - we tend to be friendly here (usually).

Starling - I just thank God for you. :-) You come out of the nowhere and rescue these topics that abusive personalities have tried to take over.

Of course, why should anyone be expected to understand and properly use the English language, and why stop there? Why should anyone understand government or politics either? In this new world model of American Idol, we should all undertake positions we are not qualified to pursue. Surely the world will be a better place. While you may see a hopeless victim of a flood, I see a conniving individual who is using the flood to position his own motivations. Isn't this the same Chad Quigley who bought an abandoned house and has funded the renovation "by other means" because he was unemployed, who hounded the city to tear down houses adjacent to his house and wants the city to hand over that land for free, who proclaims there is an underground trout stream beneath his house, and now upholds that the city destroyed his sewer line with their careless large equipment while demolishing the very houses that he bullied them to destroy. Wow, what incredible happenings. Surely restitutions are in order. You can fool some people sometimes, but you can't fool all the people all the time. ...I can see both sides on this. I have a blog so I can say what I want, when I want about what I want. I hope that others read it. When I need help with an issue (like lawn maintenance), I can choose to post about it on my blog or go to a site that has more readership (like Toledo Talk).

On the one hand, I understand Chad's posting and the interest those at S.B. have for the issue. On the other hand, I understand Tyler Durden's concern.

Had it been me - and this is a personal preference - I would have blogged about the issue on my blog and then done the 'shameless plug' for the blog post here on S.B. Again, that's just me. It would have generated the feedback I was hoping for AND driven readers to my blog.

Chad is a new blogger and a relatively new user of S.B. so that may explain any misunderstanding of 'blogger/poster etiquette'...but that's what we're talking about here - the etiquette or acceptable community standards for how and what we post.

There are ways to suggest that someone might have committed a faux pas in posting without being rude...but the perspective that Tyler has added, with his "Shenanigans...Submitted by Tyler Durden on Wed, 2007-06-06 09:02." post is also relevant to the issue.

I guess I see that there are two sides to every situation (wasn't that in a song?)...

first started commenting on Swamp Bubbles...and did not fully understand its reason for existence....I put up a post asking if anyone had ever shopped at Direct Buy and if so, did people think it was a good business to have in Toledo.

The administrator...who I understand to be Chris Myers...kindly removed my post and moved it to Toledo Talk citing that I needed to stick to community and political matters.

Having been educated on how to use this site...I have since refrained from posting anything that is personal or has nothing to do affecting Toledo politics or community. I was just surprised the adminstrator did not make Chad aware of this...as he did me. Thats all. When there are heavy rains in any city...homes flood. Its not Toledo's fault...we live in a swamp...what do you really expect? Therefore,
asking fellow bloggers to come clean your house or reccommend legal help does not fit under "community," or "helping community."

The fact that those of us (me and Tyler) who chastised Chad are called bully's or newbies is not fair. I've been blogging long before SwampBubbles was around and was commenting at Toledo Talk since the first week in was on-line. ToledoPlusPlus...your attempt to be the 'rational one' on this blog, saving fellow bloggers from "assholes" is self serving and a bit comical. By the way...I didn't see any comments from you offering to help Chad out.

And I couldn't agree more. I've done a thorough house cleaning here, I've decided not to read abusive posters' comments anymore. It's too difficult to resist responding and it certainly isn't a growing experience for me. And that's what life is all about, learning, growing and being good to one another. Some folks are just $&&holes - it is a fact of life. And I'm all through defending acknowledging that I've stumbled across a full blown know it all abusive $&&hole in the wilderness. Shooting the messenger is a futile endeavor.

Term them what you will, abusive, know it alls, self-appointed expert on EVERRRRRRYTHING they encounter - I just don't have the stomach for it anymore.

Give me the people who also have more questions that answers. Give me the people who like to debate other points of view. Give me the people who like to marshal resources together and use them to accomplish a common goal. These are the folks that are going to get my time.

it may be one explanation but y'know for bait to be effective somebody has to bite it. It's difficult not to sometimes, the Lord knows I know that! But hey - why waste the time when there are very interesting people to spend the time on?

I use prepaid legal - I used them again today to get some help to get copies of my daughters' test results released. I really like my policy - I use it quite a bit. If I had the time I'd go to work selling it. For 24.00 a month everybody should have a fulltime law firm.

tyler I don't think it's your opinions that disturb, it's how you present them - snide, arrogant, sniping, smug. I personally have disagreed (loudly at times) with just about every poster here at one time or another, and they've dished it out to me plenty of times. It's not the content - it's the tone in how you relate to people that is abrasive. I do not mean to offend you by saying this - but it seems to have been the case with the last couple of posters that ended up being labeled as 'trolls'. Not what they said as much as how they said it. I suggest that if this board displeases you so much, you stay away. Or, take the time to get to know people without the sarcasm & smugness. Lots of nice people here. But too often there's been new posters who barge in smashing everybody with no regard for manners or feelings. Usually, they turn out to be very young, very full of themselves. The last one accused us all of not accepting him or his ideas because he 'wasn't old like us, but we'd die sooner, so there." I have not witnessed anybody having age issues here - I've agreed & disagreed with many much older & younger than me. But when ya come off as a bratty child.............

Mags is right, there is always two sides to every story. Both Chad & Tyler make some points, perhaps next time Tyler could be better at his timing, i.e. not making points on another when they are still down.

A couple of weeks ago, I met Chad and toured his house. What I got out of it was Chad and his wife found their dream house. They found it in a place where many people would not look. Chad has spent a tremendous amount of time putting together the house and bringing something back that most people would look past and has a great house now. Chad had vision and in my opinion won the lottery. Now that area is becoming quite interesting. Chad has done a tremendous job on getting the City to focus on an area that is neglected. Too many times government gets into cruise control and tends to let things slide. Someone has got to keep them on their toes.

I don't think you should sue the city. I know this does nothing to mitigate your losses, which seem quite big. I think a lot of us feel bad for you especially given the yeoman's job you have done up until this point. It seems like a backflow valve could stop what happened. I am not an expert, but I have noticed that land without much grass cover tends to shed water more than absorb it. It may be all that recently cleared land shedded all of the water last weekend to the streets, thus partially being responsible for the flooding. Chad, I would work to get some grass on those empty lots around your house and install the back flow valve, that may do more in the interim to help alleviate the problem while the City checks the sewers. Regardless, suing the City will take years and maybe the next rain like that is right around the corner. I don't know if it is such a clear cut case that they are responsible for the flooding. It may be hard to prove, but you have been very thoughtful up until this point, I am sure you will do what is right. That is my own take on the situation, although I am not an expert.

With the passion Chad has it was sad to hear what happened. Like T++ said, the flooding is an issue and it was good to have a first person account of what happened in that area. Chad was the only one posting over a period of several days so it began to appear it was about Chad. Just because he was the only one does not mean that he is taking over the forum. Anyone here could have submitted a story.

I did think twice about the lawyer request being he was asking for advice, but since Chad has been so visible about it, I decided to leave it open because he has become a "limited purpose public figure".

One last thing. We're talking about the City of Toledo's Adminstration here. You'd be an idiot not to retain a Lawyer. And I've found just the guy for the job. You see, even if the City comes to me, I still have to have someone smarter than me to make sure I don't accidentially screw myself along with letting the City. I was born at night folks..but not last night.

you're ruffling some feathers down at One Government Center. I've been told by a participant that for a while the C man was having meetings almost daily about what to do with you... how to handle you... you are a thorn in his side.

Tyler, are you a city administrator? Your comments have such contempt, almost as if you've "had it up to here" with the situation. Just seems a little strange considering the regular Joe reading about Chad's issues might not speak so sharply.

Best of luck to those struggling with flooding in this city. I was very glad that we waterproofed our basement in 2000. We purchased in 1998 and in 1999 had our first experience with a "once in 100 yrs" event. There have been several neighbors who have flooded since and I am very thankful that I don't have to tear out carpet again.

Not that I'm defending myself..but before you go running on about what you "think" I'm up to, perhaps you should know all of the facts.

Less than 12 days ago, the SBH demo'd a 2 story carriage house just off the nw corner of my home. In doing so, they used grapling hooks and Large bulldozer(s). They mowed over some of the trees, they up-rooted others completely. We're not talking saplings here, we're talking 40+ year old trees, roots and all. Some of the trees we from inside the building no less.

The problem is the sewer main runs ajacent to that structure and my home. Pulling trees out, driving heavy equipment repetedly, the demo equip. and the lg load trucks to remove debris, along with other existing water issues with curb drains and street sinking have all contributed to the apparent collapse of the sewer main from my yard to the other end of the block. To wit...the City has yet to do anything at all about. My waste water is flowing freely into the surrounding landscape. And if it rains before they repair it..I will flood like a bitch again. 15 minutes to get 3 feet of water in a nearly 2000 sq ft basement is insane no matter how much rain falls. Last year june 21st, we had more rain than fell Sunday and we were dry as a bone. The basment walls do not leak and I've replaced all of my windows. In addition, the City backfilled a demo'd next to me with 15 feet of solid clay...making it a non-draining neighbor.

I have been trying to get this situation fixed for a year and only in the last month have they even looked at it. The careless, cheapskate manner they employed to demo the carriage house resulted in the damage to the sewer, doing nearly $150,000.00 worth of damage to my home structure and my personal belongings. Some of which are not replaceable. Had this souly been an act of God or Nature or whatever..I'd be less hostile. The sad reality is the City of Toledo ignored me untill it was too late, as is their apparent policy on everything.

So Ty..... I firmly believe this is a City problem and they now owe me complete restitution and complete replacement of the sewer line on my block..NOW! If you don't like my posts and/or comments..by all means, don't feel obligated to read them or share:-)

And its' quite obvious your new as well. Some of the people on this board have been around for years when most conversations were taking place at ToledoTalk, and some have even met up face to face to get a glimpse of whose behind the computer. Why? Because there is a sense of community here, or at least on some level for some of the more active users. Jim Avolt gets on here and discusses his problems as a business owner, even though the smoking issue is political, its' still a personal issue for him. Chris Meyers posted about his decision to run for the Toledo Board of Education, which absolutely has everything to do with politics, but he still used the forum like its' the Sunday Ad. And here, Chad is stuck in the middle of a personal problem, yet, FLOODING IS A POLITICAL ISSUE HERE IN TOLEDO AND HAS BEEN -- especially ever since the flooding last June. People are pissed, and its' not just Chad. Sometimes, shit doesn't get done until a lawyer has to be called in. So, in my opinion, this is absolutely relevant.

And while Jim, Chris, and others have used this board for their issues, people on here have had the opportunity to support them in their effort and rally behind them -- because thats' when shit gets done, when its' done as a community. Maybe, through this post, Chad could have added a few more upset homeowners and neighbors to form as one and speak loudly to City Council to fix this damn problem. And while yes, this board is centered around politics, nothing in the rules has said it can't be about politics hitting on a personal note.

To be honest, I get on this board because I feel I have an investment in this area, my hometown, and its' nice to discuss that investment with others with the same goal of seeing this area improve -- no matter which direction that be. Without that, there's no other reason to discuss about Northwest Ohio.

Sorry I don't have a recommendation for ya Chad, but best of luck to you in getting done what needs to be done.

It's probably on 'Free' Republic more than anywhere else(a lot of good people there, but it's slowly being taken over by elitists), but I'm seeing it spread. Just/still more elitist horseshit ("I'm smarter/better than you because I have a greater command of the english language"). Christ, more than half of my mistakes are due to my keyboard being an obsolete POS with sticking keys.

the one thing I like about this board over Toledo Talk-you can actually see WHO's doing the posts-so you can keep your blood pressure down, as well as not give yourself an unwanted ulcer. 8^)

And while I haven't called anyone a newbie for a while, I have noticed -we're unfortunately going through another period where most (not all) of the people new to the boards (here and TT) seem to be still more of the agitator/troll variety. At the same time Maggie, flooding IS a hot political issue at the moment. MANY residents are pissed off. Its' not like Chad's house was the only one affected by the rain, many have been affected, which leads to this being a political issue. Like I had said before, Chris Meyers has used this board as a sounding board for his run for the Toledo Board of Education. Jim Avolt has used this blog in regards to the smoking ban and how its' affecting his business and other businesses, but its' still political while being personal. As is this, POLITICS CAN BE PERSONAL. Perhaps a lawyer could be used by several neighbors or area residents who have been affected to force the city to do something, not necessarily for a handout of money.

Chad you have to keep us informed now. The cat is out of the bag and we are all interested. We want to know what happens in the next in the aventure of Chad Quigley. Please keep us posted.

Who is being the elitist now? Perhaps what you are experiencing is new posters not returning because they quickly learn that differing opinions from that of the established are quickly labeled as abusive newbies and trolls.

...that there is relevance...but I also understand how someone else could think there isn't..

If you don't know a laywer that is a family friend, forget it, or on the othe hand if he can make a lot of money on a law suit then maybe they are all good.
